Workers’ Compensation – Attorney’s Fees – Unfounded Litigiousness Claim – First Impression Issue (access required)

Burnham v. McGee Brothers Co. In workers’ comp decisions involving housing for wheelchair-bound claimants, our appellate courts have addressed the initial cost of rendering the claimant’s housing handicapped-accessible, but we have not addressed the question at issue here: defendants’ liability for an increase in ongoing rent payments incurred because of an upgrade to a two-bedroom apartment so the claimant would have a place to store his equipment, medical supplies, and mobility assistance devices.
