Raleigh firm named one of country’s best for patent law

Raleigh-based Myers Bigel Sibley & Sajovec was recently ranked among the top 50 patent law firms in the U.S. by IFI Claims Patent Services, a producer of global patent databases, analytic solutions and innovative web services. The firms were ranked by number of U.S. patents granted to clients in 2011.

“We are pleased and gratified that the service that we are able to provide to our clients has resulted in such a large number of issued patents,” said managing partner Jim Cannon. “We strive to provide high quality service to our clients, and we believe that the results of the rankings are evidence that we are doing so.”

Myers Bigel is the largest independent patent law firm in North Carolina, with 37 attorneys serving corporate and university clients in the chemical, pharmaceutical, biological, mechanical, electronics, and computer technology areas. The firm was ranked 35^th, having secured 749 patents for its clients in 2011.

The firm has seen an uptick in new clients as companies here and elsewhere in the country emerged from the economic downturn in search of value, not only in terms of cost but also professional depth and low attorney turnover, Cannon said. Many of the firm’s attorneys had extensive experience in particular areas before turning to the practice of law, thus bringing a different perspective to the patent process.

Topping the list was Oblon, Spivak, McClelland, Maier & Neustadt, in Alexandria, Va., with 5,613 patents.

Other ranked firms with offices in N.C. included Kilpatrick Townsend & Stockton, with 1,669 patents and K&L Gates, with 841.

Neither plaintiff nor the individual defendants are Texas residents; nevertheless, each of the individual defendants’ employment agreements includes an unambiguous and mandatory forum selection clause, which says any lawsuit involving the agreement must be brought in Harris County, Texas. The employment agreements were entered into by plaintiff’s predecessor and the individual defendants, who apparently did not live in Texas when they entered into the contracts and thus apparently anticipated interstate travel in the event of a trial.
