Bankruptcy – Dischargeability – Real Property – Tort/Negligence – Fraud – Real Estate Broker
Fazzari v. Hilbrant Plaintiffs allege that defendant Poag, a real estate broker, failed to disclose: (1) that he and Infinity Partners (the owner of the real estate brokerage) made direct loans to the developers of Grandfather Vistas of Blowing Rock (GFV), (2) that the developers were in financial distress and not likely to perform on their guaranteed repurchase of lots in (GFV), (3) that the developers were improperly diverting funds to other projects, (3) that the developers were switching plaintiffs’ lots to less desirable locations, and (4) that the developers were not timely recording deeds.
