State v. Wilson Even though the photograph of defendant was smaller than the photos of the other five men in the photographic line-up, defendant cites no case in support of the proposition that admission of an identification based on a smaller photograph is an error requiring mistrial, and our research reveals no such case. The size discrepancy was not impermissibly suggestive.
