Rahamankhan Tobacco Enterprises Pvt. Ltd. v. Evans MacTavish Agricraft, Inc. While defendant was trying to repair the lamina press it had sold to plaintiff, plaintiff allegedly entered into a contract to buy a replacement from a different seller; such conduct does not convert this contract dispute into a tort dispute. Rather, depending on the outcome of the contract dispute, plaintiff’s acts may have either mitigated its own damages or aggravated defendant’s damages.
