Criminal Practice – SBM – Indecent Liberties – Recidivist

State v. Williams. (Lawyers Weekly No. 10-07-1015, 10 pp.) (Linda Stephens, J.) (Rick Elmore, J., concurring in the result only without separate opinion) Appealed from Wake County Superior Court. (William R. Pittman, J.) N.C. App. Click here to read the full text of the opinion.

Holding: Even though the trial court erroneously found that defendant had been convicted of “an offense against a minor” and that defendant’s conviction involved “the physical, mental, or sexual abuse of a minor,” since the trial court correctly found that defendant had been convicted of a reportable conviction and was a recidivist, the trial court’s findings support its order that defendant enroll in satellite-based monitoring for life.

Affirmed.
