United States of America v. Marvin Barnette. Under N.C. law, breaking or entering is a violent felony as a matter of law; therefore, the trial court correctly counted defendant's prior breaking or entering conviction as a violent felony offense in the court's calculation that defendant qualified as an armed career criminal.
