Joyner v. North Carolina Department of Health & Human Services The defendant-agency failed to rule on whether plaintiff’s expenditures for his late mother were made out of family obligation or the expectation of compensation, so we remand to allow the agency to make this finding. We affirm the agency’s ruling that a lump-sum transfer for future personal care was not for fair market value, and we reverse the superior court’s ruling to the contrary. We also reverse the court’s award of attorney’s fees to plaintiff.
