FIA Card Services, N.A. v. Campbell The only documents plaintiff offered as evidence that a credit card account existed between the parties were three statements from the months of August-October 2008. Such evidence was insufficient to satisfy G.S. § 8-45; therefore, a genuine issue of material fact existed as to whether defendant entered into an agreement with plaintiff or incurred the charges alleged.
