NLRB appeals ruling on posting of union notices

CHARLESTON (AP) — The National Labor Relations Board has filed an appeal that could sort whether private businesses can be forced to post notices informing workers about their rights to join or form a union.

The board filed a notice that it was seeking to appeal Chief U.S. District Court Judge David Norton’s ruling that the requirement exceeds the federal agency’s powers.

The U.S. Chamber of Commerce and the state Chamber of Commerce sued over the rule in September 2011. The NLRB has said the agency has the right to require the posters under the National Labor Relations Act just as other workplace posters inform workers of rights under other laws.

In a separate lawsuit, a federal judge in Washington found the NLRB could require the notices. Appeals could resolve the differing rulings.
