Landlord/Tenant – Commercial Lease – Summary Ejectment — Amendment

Landlord/Tenant – Commercial Lease – Summary Ejectment — Amendment

Raether v. GCO Energy Corp (Lawyers Weekly No. 12-16-0678, 8 pp.) (Robert N. Hunter Jr., J.) Appealed from Wake County District Court. (Christine Walczyk, J.) N.C. App. Unpub. Full-text opinion.

Holding: Although the trial court found that there was no meeting of the minds between the parties to form a valid lease, the evidence shows that there was a landlord/tenant relationship between the parties. Therefore, summary ejectment was an available remedy.

We affirm the trial court’s order granting possession to the landlord.
