Adoption statute may be unfair to father, court rules (access required)

A North Carolina statute setting out when a biological father’s consent is needed for adoption may be unconstitutional as it applies to one father, the state’s Court of Appeals has ruled. The court sent the case back to the trial court to determine whether the facts are what the father says they are. If so, the court said his permission is required before the child can be adopted.
