Bankruptcy – Lifting the Automatic Stay – Real Property – Mortgages (access required)

McCullough v. Horne Where (1) the creditors received only one payment from the debtor after the bankruptcy petition was filed; (2) the creditors had not received mortgage payments for approximately 17 months prior to the debtor’s filing for bankruptcy; and (3) despite the creditors’ demands, the debtor never obtained insurance on the property, the creditors’ interest in the mortgaged property was not adequately protected.
