Washburn v. Washburn Even if the plaintiff-wife intentionally gave false testimony at the parties’ equitable distribution trial, the defendant-husband’s motion to set aside the equitable distribution judgment still fails. At the hearing on his motion under N.C. R. Civ. P. 60(b), the husband provided no evidence or argument showing how he was prevented from litigating his equitable distribution claim due to the wife’s alleged fraud.
