FAYETTEVILLE (AP) — A former Fort Bragg soldier convicted in a triple slaying in 1985 has again appealed his conviction in military court.
The Fayetteville Observer reports that 55-year-old Timothy Hennis was sentenced to death in 2010 for the slayings of Kathryn Eastburn and her two young daughters.
Hennis is a former master sergeant brought out of retirement to face a court-martial nearly two decades after his conviction in state court was overturned and he was found not guilty
Lawyers for Hennis, who is in military prison, filed another military appeal last week. They say the military lacked jurisdiction to hold a court-martial because of a break in Hennis’ military service.
The U.S. Supreme Court in 2012 refused to review Hennis’ arguments.
