Criminal Practice – Hydrocodone Possession – Indictment Amendment – Schedules II & III

State v. Stith (Lawyers Weekly No. 010-033-17, 18 pp.) (Per Curiam) Appealed from Johnston County Superior Court (Claire Hill, J.) On appeal from the Court of Appeals. N.C. S. Ct.

Holding: We affirm our Court of Appeals’ decision (Changing an indictment by striking through one mention of “Schedule II” was not an impermissible amendment to the indictment.).
