A disbarred Lincoln County lawyer has pleaded guilty to 11 counts of embezzlement and was sentenced to at least 12 years in prison, according to the county’s district attorney.
Peter Capece, who was disbarred in May 2015, pleaded guilty on June 26 and was sentenced to two consecutive active terms of 72 to 99 months, followed by 60 months of probation, District Attorney Mike Miller told Lawyers Weekly in an email. Three additional terms were suspended.
Capece, 41, embezzled nearly $1,600,000 from the estate of Fritz Detmers of Denver, who died at age 78 in 2009, although the criminal trial involved only about half of those funds. He is being incarcerated at Tabor Correctional Institute, according to records from the state’s Department of Corrections.
Detmer’s widow, Charlinette Detmers, also 41, is awaiting trial on charges also related to the embezzlement.
