Contract – Real Estate Agent – Full Commission – Post-Termination Closings

Even though the parties had discussed two different positions for the plaintiff-real estate agent, their testimony – that plaintiff wanted to be paid her full 1.25 percent commission “regardless of her status” with the defendant-company – was sufficient to support the trial court’s finding that plaintiff was entitled to a 1.25 percent commission on contracts that she wrote but that closed after the parties terminated their working relationship.

We affirm the trial court’s $17,524.49 judgment in favor of plaintiff.

Silver v. Chase Properties, Inc. (Lawyers Weekly No. 012-092-18, 16 pp.) (Mark Davis, J.) Appealed from Orange County District Court (Sherri Murrell, J.) Kim Steffan for plaintiff; George Currin for defendant. N.C. App. Unpub.
