Exclaim Marketing, LLC v. DIRECTV, Inc. Where plaintiff’s marketing efforts sent potential customers to defendant’s dealers, defendant was a non-outsider to plaintiff’s contracts with the dealers. The complaint itself reveals that defendant’s interference in plaintiff’s contracts with its dealers was justified by defendant’s legitimate business interests: an interest in controlling how and by whom its products and services are marketed, protection of its trademarks, and its competition with Dish Network.

Aecom Technology Corp. v. Keating By alleging that defendant Keating was one of plaintiffs’ corporate officers, plaintiffs have sufficiently alleged that Keating owed plaintiffs a fiduciary duty. Defendants’ motion to dismiss is denied as to plaintiffs’ breach of fiduciary duty, unfair trade practices, and conspiracy claims. Defendants’ motion to dismiss is granted as to plaintiffs’ misappropriation of trade secrets and tortious interference with contract claims.

Vurimindi v. Link In a prior lawsuit in Pennsylvania, plaintiff’s claims against several of the defendants were dismissed for lack of personal jurisdiction. However, as to a defendant over whom the court in Pennsylvania had jurisdiction, plaintiff’s claim of tortious interference with contract was dismissed because of plaintiff’s failure to show the existence of a contract between plaintiff and Duke University. Collateral estoppel thus bars plaintiff’s claims of tortious interference with contract based on his alleged contract with Duke.

Edwards v. PCS Phosphate Co. Since the N.C. Retaliatory Employment Discrimination Act does not define “employee”, but since a retaliatory discharge claim under REDA can only be brought by a former employee, the court concludes that a former employee can bring a claim under REDA. Defendant’s motion for summary judgment is denied.
