The plaintiff, a 73-year-old man, was admitted to a nursing home for care as he recovered from an ankle fracture that occurred at his home. Though only a resident for 27 days, he suffered a significant health decline, as well as the development of multiple pressure ulcers, including Stage 4 gangrenous ulcers to his buttocks, sacrum, and scrotum, that were not properly assessed nor treated. He was hospitalized and treated but died two weeks later. Plaintiff alleged that his injuries and wrongful death were the result of systematic and ongoing administrative and managerial corporate failures that led to a culture of abuse and neglect at the facility, leaving it understaffed with poorly trained nurses, improperly managed, and unable to meet the needs of its residents.
