The 13-year-old plaintiff had just gotten home from school and was crossing the street to check the mail when he was struck by a vehicle and severely injured. According to the police report, the plaintiff “darted” out in front of the vehicle. The case was initially a denied liability case, but after hiring experts and an extensive investigation, the insurance carrier for the driver paid the $1 million that its insured had.
Plaintiff’s counsel added that he had a $300,000-plus Medicaid lien waived in its entirety.
