SMITHFIELD (AP) – There’s been a delay in the federal lawsuit on behalf of a Clayton High School student who was suspended because of a piece of jewelry in her nose.

The News & Observer of Raleigh reported last week that attorneys for 14-year-old Ariana Iacono and Johnston County Public Schools agreed to have the case delayed until Feb. 14.

A federal judge issued an order in October that Iacono be allowed to return to classes after she had been suspended for wearing a small nose stud that she said was an expression of her religious beliefs.

The American Civil Liberties Union of North Carolina sued in federal court in October saying the school violated Iacono’s constitutional rights by refusing to grant religions exemption to its dress code.

Iacono and her mother belong to the Church of Body Modification.
