Husband and wife, both retired, were traveling on I-485 in Charlotte when they were involved in a multi-vehicle collision caused by the driver of a commercial landscape company truck. Plaintiffs were both hospitalized initially, with husband requiring multiple readmissions for complications followed by inpatient rehabilitation and ongoing in-home care for his injuries. There was a small payment to another driver involved in the collision, leaving $990,000 on the underlying liability policy. The carrier for the landscape company paid the remaining coverage and the entire $2 million excess policy. Plaintiffs then recovered another $2.5 million from their underinsured motorist carriers for a total recovery of $5.49 million.
